2. Acknowledgment
These Terms set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. They apply to all visitors, customers and others who access or use the Service, including software agents and AI assistants that connect to the API on your behalf.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Your use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy, which describes how we collect, use and protect personal data. Please read it before using the Service.
If you use the Application or the API under a Customer Agreement, the Customer Agreement governs in the event of a conflict with these Terms.
3. The Service
Roamtime produces travel timing forecasts, beginning with autumn foliage in Japan. The Forecast Data is delivered through three surfaces:
- The Website, which shows a free public preview of the forecast for a curated set of spots, with viewing windows rather than exact peak dates.
- The Application, which shows the complete dataset to signed-in customers.
- The API and MCP server, which return Forecast Data as JSON to your software or your AI assistant. Anonymous MCP requests receive the Free Tier; requests carrying a valid API key receive the complete dataset.
We may change the coverage, the format, the refresh schedule and the features of the Service at any time. Forecasts are refreshed during the season and the values returned on one day may differ from those returned on another.
4. Licence to forecast data
All Forecast Data is the property of the Company and is protected by copyright, database rights and other intellectual-property laws. All rights are reserved except as expressly granted below.
4.1 Free Tier
Subject to these Terms, the Company grants you a limited, revocable, non-exclusive, non-transferable licence to view the Free Tier on the Website and to retrieve it through the MCP server for your own personal, non-commercial trip planning, including through an AI assistant acting on your behalf. Any display or reuse of Free Tier data outside the Service must credit "RoamTime foliage forecast" and, where practical, link to https://roamtime.ai.
4.2 Keyed access and commercial use
Any commercial use of Forecast Data, any use of the complete dataset, and any use of the REST API require an API key or an Account issued under a Customer Agreement. Commercial use includes, without limitation, displaying Forecast Data in a product or service offered to others, using it to rank, package, price or market travel products, and using it inside an internal business process. The scope, term, permitted number of users and fees for keyed access are set out in the Customer Agreement.
4.3 What the licence does not allow
Except as expressly permitted in writing by the Company, you may not: copy, redistribute, publish, sell, rent, sublicense or otherwise make Forecast Data available to third parties; store or cache Forecast Data beyond what is needed for the permitted use; combine Forecast Data with other data to create a derivative dataset or a competing forecast; remove or alter any attribution, notice or watermark; or use Forecast Data to train, fine-tune or evaluate a machine-learning model without a Customer Agreement that permits it.
5. Acceptable use
You agree not to, and not to allow any third party to:
- access the Service by any automated means other than the API and MCP server, including scraping the Website or the Application;
- circumvent or attempt to circumvent any access control, rate limit, authentication or Free Tier restriction;
- share, publish or transfer an API key, an access code or an Account, or allow more people to use an Account than the Customer Agreement permits;
- reverse engineer, decompile or attempt to derive the forecast models, calibration data or source code of the Service;
- send unsolicited or abusive messages through the contact form, or submit false information;
- interfere with the operation of the Service or impose an unreasonable load on its infrastructure;
- use the Service in violation of any applicable law or in a way that infringes the rights of others.
6. Accounts and API keys
Accounts and API keys are created by the Company when a customer is onboarded and are personal to the customer named in the Customer Agreement. You are responsible for keeping your access code, sign-in codes, session and API keys confidential, and for all activity that occurs under them. Notify us immediately if you believe a key or Account has been compromised; we will rotate it. We may suspend or revoke a key or Account that is being shared, that exceeds its permitted usage, or that is used in breach of these Terms. Access ends on the date set in the Customer Agreement unless renewed.
7. Forecasts are estimates
Forecast Data is produced by statistical and phenological models applied to weather observations and historical records. It is an estimate of natural events that are inherently uncertain, and it is provided for information and planning purposes only. Actual foliage timing, colour quality and conditions at any spot can differ from the forecast because of weather, altitude, species, local management and other factors we do not control. Each forecast carries a confidence range; a peak can fall outside it.
You are solely responsible for any travel, booking, marketing, pricing or business decision you make using Forecast Data, and for verifying local conditions, access, opening hours, safety and transport before you or your customers travel. Forecast Data is not a guarantee of any outcome and is not professional advice.
8. Intellectual property
The Service and its original content (excluding content provided by you), features and functionality, including the Roamtime name, logo, forecast models, Forecast Data, editorial text, translations and design, are and will remain the exclusive property of the Company and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent. Nothing in these Terms transfers any intellectual-property rights to you.
By sending us feedback, suggestions or an enquiry, you grant us a non-exclusive, perpetual, royalty-free licence to use it to operate and improve the Service.
9. Links to other websites
The Service contains links to websites and services that are not owned or controlled by the Company, such as official tourism pages, transport operators and the documentation of AI clients. The Company has no control over, and assumes no responsibility for, the content, privacy policies or practices of any Third-party Service. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or service. We strongly advise you to read the terms and privacy policies of any third-party website or service that you visit.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination your right to use the Service ceases immediately and you must stop using and delete any Forecast Data obtained under a terminated key or Account, except to the extent a Customer Agreement provides otherwise. Sections 4.3, 7, 8, 11, 12, 13 and 14 survive termination.
11. Limitation of liability
Notwithstanding any damages that you might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by you through the Service in the twelve months preceding the claim, or 100 USD if you have not made any payment through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy, a trip, booking or campaign that did not coincide with peak conditions, or any other pecuniary or other loss) arising out of or in any way related to the use of or inability to use the Service, the Forecast Data, third-party software or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms, even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions each party's liability will be limited to the greatest extent permitted by law.
12. "AS IS" and "AS AVAILABLE" disclaimer
The Service and the Forecast Data are provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects, without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind, that the Service or the Forecast Data will meet your requirements, achieve any intended results, be accurate, reliable, timely or complete, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards, or be error free, or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither the Company nor any of its providers makes any representation or warranty of any kind, express or implied, as to the operation or availability of the Service, or the information, content and materials included thereon; that the Service will be uninterrupted or error-free; as to the accuracy, reliability or currency of any information or content provided through the Service; or that the Service, its servers, the content or emails sent from or on behalf of the Company are free of viruses, scripts or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you. In such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
13. Governing law
The laws of the Commonwealth of Pennsylvania, United States, excluding its conflict-of-law rules, govern these Terms and your use of the Service. Your use of the Service may also be subject to other local, state, national or international laws.
14. Disputes resolution
If you have any concern or dispute about the Service, you agree to first try to resolve it informally by contacting the Company at the address in section 20. We will do the same before starting any formal proceeding against you.
15. For European Union users
If you are a consumer in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms limits those rights.
16. United States legal compliance
You represent and warrant that you are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.
17. Severability and waiver
Severability. If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver. Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise that right or require that performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
18. Translation interpretation
The Website is offered in English, Simplified Chinese, Traditional Chinese and Japanese, and these Terms may be translated for convenience. You agree that the original English text shall prevail in the case of a dispute.
19. Changes to these Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice before the new terms take effect, by posting on this page and, for Account holders, by email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after a revision becomes effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, in whole or in part, please stop using the Service.
